The use of the NHSScotland Photo Library is subject to the terms and conditions set out below.

The NHSScotland Photo Library is managed by Capture Ltd on behalf of the NHS in Scotland and the Scottish Government (referred to as ‘We’ below). In entering our site you as a user (‘You’) are accepting our terms and conditions.

Access and use of the NHS Photo Library constitutes your acceptance of these terms and conditions. They take effect from the date on which you first use this website.

Who can access the NHSScotland Photo Library?

The NHSScotland Photo Library is a password-protected site for the use of staff within NHSScotland and our partner organisations. To access the site you must register, or seek a sponsored registration.

Where can I use images taken from the NHSScotland Photo Library?

The library is provided as a resource for you to access images for use in official publications of NHSScotland and its constituent Boards or partner organisations. Examples of suitable publications include

  • magazines
  • brochures
  • public and patient information leaflets
  • posters
  • presentations
  • educational materials
  • recruitment materials

What are my responsibilities?

You agree to use this site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.

Staff of NHSScotland and the Scottish Government are contractually obliged to process and preserve personal data securely (EU General Data Protection Regulation 2018, and the UK Data Protection Acts of 1984 and 1998).

Using our images

Who is in these pictures?

Images in the NHSScotland photo library have 'model release' consent, to be used for legitimate NHSScotland and Scottish Government purposes. The majority of images feature real staff and patients in real consultations. You are obliged to respect their generosity by taking care of the images and the information associated with them. Misuse of any image and failure to comply with these instructions could result in disciplinary action being taken against staff or legal action being taken against anyone who is not a member of NHSScotland staff.

Can I download and save images?

Staff of NHSScotland and the Scottish Government are contractually obliged to process and preserve personal data securely (EU General Data Protection Regulation 2018, and the UK Data Protection Acts of 1984 and 1998). Therefore downloaded images must

  • be kept secure at all times
  • be deleted after use

Users may not create or store local collections of images from this library. From time to time images may be withdrawn from the library for legal, technical or social reasons, (e.g. on request of family members following the death of a subject) and locally held collections cannot reflect such changes.

The images in this library are for the use of staff of NHSScotland, its constituent boards and the Scottish Government. Images may be used in or on official publications including but not limited to websites, magazines, brochures, public and patient information leaflets, posters, presentations and recruitment materials.

Under no circumstances should images be downloaded for purely personal or social use.

Are image available for sharing?

Images may be made available to outside agencies and partners undertaking work on behalf of NHSScotland, its constituent boards and the Scottish Government. In such cases an authenticated NHSScotland or Scottish Government user must act as sponsor and use of the images must be limited to the specified project.

They must not otherwise be made available to any person or organization outside of NHSScotland without the express prior permission of the NHSScotland photo library administrator via nhss@capturemail.co.uk, or someone explicitly authorised to act on their behalf.

No image should be used in any publication or other media in any way that conflicts with NHSScotland communications policies, house style or any other NHSScotland policies or which would conflict with the 'model release' consent obtained.

Images must be used in accordance with NHSScotland values - to improve the health of the people in Scotland, deliver high-quality health and social care services, and address inequalities in health more effectively.

What about downloading images to portable media?

Portable media should not be used. Sharing facilities in the library (Lightbox feature, the Saved Search and Saved Baskets facility on the site) mean users should not need to use portable media.

You are reminded that under the European General Data Protection Regulation now in force images are considered as personal information and need to be stored and transferred with the same security safeguards as other personal data is handled within the NHS.

If there is no other alternative you may download images to portable media for the sole purpose of supplying images to partner agencies such as social work teams, or design agencies involved in business partnership projects. In this case the partner agency must be supplied with a copy of these terms and conditions of use from this website. They must be informed that the use of the images is restricted to the specific project and the images may not be retained on completion.

Presentations, documents and other publications featuring images may be stored on portable media. These items must be kept securely in line with NHS policy and procedures on data handling.

Any requests for copies of such images to be used separately from these publications must be referred to the NHSScotland photo library. nhss@capturemail.co.uk

You must not otherwise download individual images or collections of images to USB sticks, CDs, DVDs or any other portable devices without the express written permission of the NHSScotland photo library administrator (email nhss@capturemail.co.uk) The photo library administrator may need to gain higher authorisation to give this permission so please allow plenty of time for your request.

Who holds the Copyright for images in this collection?

The material on this site is subject to copyright protection of the Crown unless otherwise indicated. The Crown copyright protected material may be reproduced free of charge in any format or medium for research, private study or for internal circulation within an organisation. This is subject to the material being reproduced accurately and not used in a misleading context.

Where any of the Crown copyright items on this site are being republished or copied to others, the source of the material must be identified and the copyright status acknowledged.

The permission to reproduce the Crown protected material does not extend to any material on this site that is identified as being the copyright of a third party. Authorisation to reproduce such material must be obtained from the copyright holders.

What is your Links Policy?

Links are provided for information and convenience only. We cannot accept responsibility for the sites linked to, or the information found there. A link does not imply an endorsement of a site; likewise, not linking to a particular site does not imply lack of endorsement.

The Photo Library is normally available 24/7 via this website. We cannot guarantee uninterrupted access to this website, or the sites to which it links. We accept no responsibility for any damages arising from the loss of use of this information.

What about intellectual property?

The names, images and logos identifying the NHSScotland Photo Library are the proprietary marks of NHSScotland. Copying our logos and any other third party logos accessed via this website is not permitted without the prior approval of the relevant copyright owner.

Virus protection

We make every effort to check and test material at all stages of production. It is always wise for you to run an anti-virus programme on all material downloaded from the internet. We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system that may occur while using material derived from this website.

What happens to my personal data?

To access the NHSScotland Photo Library you need to supply details relating to your name, employment and email address. This information is used to determine your authority to access the site.
